Abstract

This article gives an overview of the law relative to the Crown's liability as a highway authority in New Brunswick. After tracing the historical roots of the rules of law which applied to highway authorities and the problems of suing the Crown at Common Law, the author illustrates the procedural technicalities of an action against the Crown under statutory law. A review of the jurisprudence of highway authority cases in New Brunswick follows. Finally, the author underlines the anomaly which distinguished the nonfeasance rule applied to the public administration. He suggests a judicial reform of the actual regime in order that the principles of the law could match the ideals of social justice in that domain.
